D.W. Dickey Unhardened Concrete SDS
CONDITIONS
D.W. Dickey & Son Inc. is a concrete supplier and does not put the finish surface on the product. Scaling is a surface issue not caused by D.W. Dickey & Son Inc.
STRENGTH The cement used in this concrete is guaranteed to conform to the present specifications of the ASTM. Since we have no control over the use of this concrete, we therefore cannot guarantee or assume responsibility for the finished work in which it is used. This load of concrete has a designated mix to meet the strength required by the customer or his agent. The addition of excess water, delay in unloading and other similar factors occurring on the job make it impossible to guarantee the strengths as indicated, and they are given only as a guide.
DURABILITY Correct placement of concrete is not complete unless it is properly cured, sealed and maintained.
WATER ADDED Additional water added to this concrete will reduce its strength. Any water added is at customer’s risk.
YIELD We do not guarantee “in place” or in the forms” yield nor any other yield calculation, except by measurement in calibrated hopper at the point of the mixer discharge or by ASTM method of determination. No yield is guaranteed when any ingredients other than our standard aggregated add mixtures and Portland Cements are used.
DELIVERY a) Delivery policy F.O.B. jobsite, curbside only. For delivery beyond curbside, the jobsite must be accessible to our trucks under their own power. Any charges or liabilities incurred beyond the point are the customer’s responsibility. i.e. wreckers, fees, property damage.
b) Timed deliveries must be confirmed with dispatcher.
c) Claims for delays for factors beyond our control will not be allowed.
d) No cancellations accepted after concrete has been loaded on truck.
e) Claims for shortage will not be considered unless made at time of delivery.
f) No credit allowed for returned concrete.
g) Our responsibility ceases when delivery is completed.
COLOR
We do not guarantee the color of concrete. The final color of the concrete may vary due to a variety of factors and we do not guarantee an exact match. Concrete is produced from naturally occurring materials: natural variations- color, efflorescence, lignite and other variations may occur. Because there are too many variables during both the manufacture of raw materials, concrete production, and those encountered during placement and finishing, we hereby disclaims any responsibility or liability whatsoever for any alleged lack of uniformity in the color or efflorescence of the concrete. Please see ASTM C33 for concrete aggregates limits for deleterious materials (i.e. shale, lignite, etc.)
CONCRETE ACCELERATORS
We are not responsible for undisolved calcium in concrete mixtures. Some of the effects of calcium chloride are but not limited to: can corrode reinforcing steel, increase set time, and create discoloration. Non- Chloride accelerator can be used at customers request at time of order. If calcium is used to help set time of concrete mixture, it is recommended to be dissolved with water. We are not responsible for defects caused by undissolved calcium in concrete.
Demurrage
The customer is allowed 10 minutes per cubic yard of concrete before demurrage is charged. The customer agrees to pay a demurrage charge set by the company for each additional minute beyond 10 minutes per cubic yard of concrete. In the event the concrete truck is required to remain at the job site due to customer’s failure to accept the concrete and/or provide adequate facilities and conditions for unloading concrete within the time described in this section, a demurrage charge will be enforced. Demurrage charges are subject to change without notice. Please contact our office for current demurrage charge (330-482-3833).
Concrete Temperature
Concrete temperature will be dictated by the environmental and material conditions at the time of delivery. Ambient temperatures, concrete temperatues, and other factors have a significant effect on set time. Because of this, set times of the concrete mixture may vary.
Clean Up Area
It is the responsibility of the buyer of concrete to provide the concrete truck with a safe and legal area to clean up after finished pouring. It is the responsibility of the buyer to make sure the concrete truck is cleaning up in the correct location.
