PRODUCT STANDARDS
Concrete provided by D.W. Dickey & Son, Inc. is produced to meet applicable ASTM C94 and specified ACI requirements, as applicable to the ordered concrete mixture.
SAFETY INFORMATION
WARNING — FRESH CONCRETE
Freshly mixed cement, mortar, concrete, and grout may cause serious skin irritation, chemical burns, or other injury. Avoid direct skin contact whenever possible. Promptly wash exposed skin with clean water.
If cement or a cement-containing mixture comes into contact with the eyes, immediately flush the eyes repeatedly with clean water and seek prompt medical attention.

- FINISHING & SURFACE CONDITIONS
D.W. Dickey & Son, Inc. is a supplier of ready-mix concrete and does not control the placement, finishing, curing, sealing, or maintenance of the finished concrete surface.
D.W. Dickey & Son, Inc. does not assume responsibility for surface conditions or defects resulting from improper placement, finishing, curing, sealing, maintenance, weather exposure, jobsite conditions, or other circumstances beyond the company’s control.
- STRENGTH
The cement used in the concrete is intended to conform to applicable ASTM specifications.
Each load of concrete is produced according to the designated mix ordered by the customer or the customer’s authorized agent. Because D.W. Dickey & Son, Inc. has no control over jobsite placement, finishing, curing, unloading time, water added at the jobsite, environmental conditions, or other factors occurring after delivery, the company cannot guarantee the strength or performance of the finished concrete work.
The addition of excess water, delays in unloading, improper curing, improper placement, and similar jobsite conditions may adversely affect concrete strength and performance.
- DURABILITY
Proper concrete placement alone does not ensure long-term durability. Concrete must also be properly finished, cured, sealed, protected, and maintained based on the application and environmental conditions.
D.W. Dickey & Son, Inc. is not responsible for durability issues resulting from improper placement, finishing, curing, sealing, protection, maintenance, or other jobsite practices beyond the company’s control.
- WATER ADDED AT THE JOBSITE
The addition of water to concrete may reduce strength and may affect durability, air content, set time, color, and other characteristics of the concrete.
Any water added to the concrete at the customer’s request or at the jobsite is added at the customer’s risk and responsibility.
- YIELD
D.W. Dickey & Son, Inc. does not guarantee “in-place,” “in-the-forms,” or other jobsite yield calculations.
Yield will be determined only through measurement using an approved or calibrated method at the point of mixer discharge or through applicable ASTM testing methods.
No yield guarantee is provided when materials or ingredients outside the company’s standard aggregates, admixtures, and cementitious materials are incorporated into the concrete mixture.
- DELIVERY
- Jobsite Access Delivery is F.O.B. jobsite, curbside only. Any delivery requested beyond the curbside requires a jobsite that is safely accessible to the concrete truck under its own power.
The customer assumes responsibility for providing safe and adequate access. Any costs, damages, or liabilities resulting from delivery beyond the curbside—including, but not limited to, towing or wrecker charges, recovery expenses, and property damage—are the customer’s responsibility.
- Timed Deliveries
Timed deliveries must be confirmed with the dispatcher. Requested delivery times are not guaranteed when delays result from circumstances beyond the company’s reasonable control. - Delays
Claims arising from delays caused by weather, traffic, equipment issues, jobsite conditions, supply interruptions, or other circumstances beyond the company’s reasonable control will not be accepted. - Cancellations
Orders may not be canceled after the concrete has been loaded onto the delivery truck. - Shortage Claims
Claims regarding shortages must be reported at the time of delivery. - Returned Concrete
No credit will be issued for unused or returned concrete. - Completion of Delivery
D.W. Dickey & Son, Inc.’s responsibility for the concrete delivery ends upon completion of delivery, subject to applicable law and these Terms and Conditions.- COLOR & NATURAL VARIATIONS
D.W. Dickey & Son, Inc. does not guarantee the final color, shade, or uniform appearance of concrete, nor does it guarantee an exact color match between loads, placements, or previously placed concrete.
Concrete is manufactured using naturally occurring and manufactured materials that may vary in color and composition. Variations may include, but are not limited to, color differences, efflorescence, lignite, shale, and other naturally occurring characteristics permitted within applicable material specifications.
Final appearance may also be affected by water content, admixtures, weather, temperature, placement methods, finishing techniques, curing, sealing, environmental exposure, and other conditions beyond the company’s control.
D.W. Dickey & Son, Inc. assumes no responsibility for variations in color, efflorescence, or appearance resulting from these factors.
Refer to applicable ASTM C33 requirements regarding concrete aggregates and permissible limits for deleterious materials, including shale, lignite, and other materials.
- CONCRETE ACCELERATORS
When calcium chloride or another accelerator is requested by the customer, the customer acknowledges that its use may affect the characteristics and appearance of the concrete.
Calcium chloride may contribute to effects including, but not limited to, changes in set time, discoloration, and corrosion concerns involving reinforcing or embedded metals.
D.W. Dickey & Son, Inc. is not responsible for defects or performance issues caused by undissolved calcium chloride or the improper use of an accelerator.
A non-chloride accelerator may be available upon customer request and must be specified at the time the order is placed.
- DEMURRAGE / UNLOADING TIME
The customer is allowed 10 minutes of unloading time per cubic yard of concrete delivered before demurrage charges apply.
If unloading exceeds the allowed time, the customer agrees to pay the company’s applicable demurrage charge for each additional minute.
Demurrage charges may also apply when a concrete truck is required to remain at the jobsite because the customer is unable or unwilling to accept the concrete or has failed to provide adequate access, personnel, equipment, or conditions necessary to unload the concrete within the allowed time.

- CONCRETE TEMPERATURE & SET TIME
Concrete temperature is affected by the environmental and material conditions existing at the time of production and delivery.
Ambient temperature, concrete temperature, material temperature, wind, sunlight, humidity, admixtures, and other conditions may significantly affect concrete set time and performance. Accordingly, actual set times may vary, and D.W. Dickey & Son, Inc. does not guarantee a specific set time.
- TRUCK CLEANUP / WASHOUT AREA
The customer is responsible for providing a safe, legal, and accessible concrete washout area at the jobsite.
The customer is also responsible for identifying and directing the driver to the approved washout location and ensuring that use of the designated area complies with applicable jobsite and environmental requirements.
D.W. Dickey & Son, Inc. drivers should not be directed to wash out in an unsafe, unauthorized, or unlawful location.
